Release of Liability for Minor
Please Read Carefully – This Affects Legal Rights
In consideration of the minor named above being permitted to participate in outdoor photography sessions at a private farm venue, including access to fields, wooded areas, natural terrain, farm structures, props, and areas where farm animals may be present (the “Activity”), organized by Bray & Bloom Holdings, LLC, a Virginia limited liability company, and its owners, members, agents, employees, and representatives, operating in Chesapeake, Virginia, I, the undersigned parent or legal guardian, agree to the following:
1. Parental Consent
I am the parent or legal guardian of the minor and give permission for the minor to participate in the Activity and to be present on the property of Bray & Bloom Holdings, LLC and its owners, members, agents, employees, and representatives.
2. Assumption of Risk
I understand that participation in the Activity involves inherent risks, including but not limited to:
uneven or natural ground surfaces
outdoor environmental conditions
farm structures and props
the presence of farm animals
I knowingly and voluntarily assume all such risks on behalf of the minor.
3. Release of Liability
On behalf of the minor and myself, I release and discharge Bray & Bloom Holdings, LLC and its owners, members, agents, employees, and representatives from any and all liability for injury, loss, or damage arising from the minor’s participation in the Activity or presence on the property, whether caused by the minor, myself, other participants, or the ordinary negligence of Bray & Bloom Holdings, LLC or its owners, members, agents, employees, or representatives.
4. Indemnification
I agree to indemnify and hold harmless Bray & Bloom Holdings, LLC and its owners, members, agents, employees, and representatives from any claims, damages, losses, or expenses, including attorney’s fees, arising out of the minor’s participation in the Activity or presence on the property.
5. Responsibility for Minor
I agree that I am responsible for the supervision and conduct of the minor at all times while on the property.
6. Property Damage
I agree to be responsible for any damage to property, structures, or equipment caused by the minor.
7. Governing Law
This agreement shall be governed by the laws of the Commonwealth of Virginia.
8. Voluntary Agreement
I acknowledge that I have carefully read this agreement, understand its contents, and am signing it voluntarily on behalf of myself and the minor.
9. Severability
If any portion of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Parent/Guardian Acknowledgment
I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I ACKNOWLEDGE THAT BY AGREEING TO THIS RELEASE ON BEHALF OF THE MINOR, I AM WAIVING CERTAIN LEGAL RIGHTS.
